What Michigan Treasury can actually do to you, and what it cannot

Michigan Treasury publishes its own list of collection actions, and it runs to 10 items: liens, tax warrants covering seizure of business and personal property, wage levies, financial institution levies, other levies, offset of refunds and other money owed to you, holding you personally responsible for business taxes, liquor license revocation or non-renewal, referral to a collection agency, and other methods as necessary. Treasury contracts with Coast Professional Inc. for that collection agency work, and an account can be referred to the Michigan Attorney General.

Driver’s license suspension is not on that list.

We spell that out because it is one of the questions we field most often, usually from someone who has read somewhere that a Michigan tax debt can cost them the ability to drive to work. Treasury’s published collection actions do not include it. The license suspensions Michigan drivers remember come out of child support enforcement and unpaid vehicle fees, which are separate statutes run by separate agencies, and Michigan’s Clean Slate to Drive reforms narrowed non-safety suspensions further from 1 October 2021.

Treasury has real teeth. That list is long enough without an eleventh item on it, and you will make a better decision about which balance to pay first if you are working from what the agency actually publishes rather than from what you have absorbed.

One more correction worth making. Treasury’s page says a lien picked up by a credit reporting agency stays in your credit history for 7 to 10 years. That is a statement about credit reporting, not about how long the lien itself lives, and the two get conflated constantly.

Do I need a Michigan-licensed lawyer for an IRS problem?

Can Michigan Treasury take my driver’s license over a tax debt?

I settled with the IRS. Does that clear my Michigan balance?
